This site is owned and operated by JHSmart Limited, and these terms govern the use of the Jhsmartstores.com website. These are our conditions of sale, and you should read them carefully as they apply to the order you have placed with us online and affect your rights and liabilities under the law. If you do not agree to be bound by these Terms and Conditions you may not use or access this website. To buy any products on the site you are required to register as an authorised user and additional Terms and Conditions will apply.
THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.
i. The supplier of the goods under your order is JHSmart Limited registered office is at 46 Syon Lane, Isleworth, Middlesex, jEngland, TW7 5NQ (company number 11928335.). All communications must be made to email@example.com or by calling +4401895444324.
ii. To register to this website, you must be over 18 years of age. You must ensure that the details provided by you on registration or at any time are correct and complete. Please inform us of any changes to your information by updating your personal details to ensure that our records are correct.
iii. When you register to use the site, you will be asked to create a password. You must keep this password confidential. If you suspect that someone else knows your password notify us immediately at firstname.lastname@example.org.
iv. If we suspect a breach of security or misuse of the site, we may require you to change your password or we may suspend your account and contact you immediately.
v. The content of the site is protected by copyright, the trademarks, and other intellectual property rights. You may not reproduce, modify, copy, or distribute for commercial purposes without the written permission from JHSmart.
vi. To be bound by a contract of purchase, a payment must be made and received by us before your order can be accepted and processed by our team as described in section 2 Price and payment.
vii. If you want to change your order (including any arrangements for delivery), you must contact us immediately as any changes may delay the delivery of your order. For more information about this please read section 3 Changes and cancellations to your order.
viii.The information and data displayed on JHSmart website is, to the best of our knowledge, accurate at the time of publication. However, JHSmart provides no guarantees, warranties, or assurances of any kind that the site is error free. We reserve the right to make modifications at any time without prior modification. Each product purchased is sold subject to its product description. We will take all reasonable care to ensure all details, descriptions, images, and prices are correct at the time of publishing. We cannot confirm the price of the item until your order is accepted by us.

2.Price and payment
i. Prices for sales are subject to availability. All prices are as displayed on the website at the time of offer. Please note, an offer cannot be used in conjunction with other offers.
ii. Clicking on the ‘Make Payment’ button in the payment screen of the checkout process will submit the order for payment. Goods can be paid for using all major credit and debit cards (Mastercard, Visa, Delta). All credit/debit card purchases are subject to the normal validation checks and authorisation procedures adopted by the card issuer.
iii. At all times our acceptance of an order takes place on despatch of the order, at which point the purchase contract will be made and you will be charged for your order. JHSmart shall not be liable for any customer or household for any financial loss arising out of the refusal, cancellation or withdrawal of any orders made.
iv. Once a payment has been accepted and processed, JHSmart will confirm this to you by sending you an email. Customers can also place orders over the phone and a contract will be formed once your payment has been processed. Your order will not be processed if your bank merchant cancels the payment.
v. The price for the goods is set out in the order confirmation that is sent to your email address when you make your order. Extra charges may apply to some orders, please see section 5 Delivery and extra charges for more information.
vi. You must pay for your goods in full at the time of placing your order. If your payment has been declined, we may contact you to help you make your order. Alternatively, you can call us for assistance. We will not deliver your goods to you until we have received all sums due and payable by you, including any extra delivery charges, if they are applicable to your order.
vii. Our order process allows you to check and amend any errors in your order. The order summary shown to you before you submit your order will summarise your order, including the total price of the goods you have ordered and delivery charges. Please check the order summary carefully before submitting you order.
viii.We will introduce sale promotions and sale periods in line with current legislation. However, products in the sale, the overall sale offer, and the duration of the sale online may differ from that in our stores.
3.Changes and cancellations to your order
i. When you make a purchase on our website, we form a contract with you. JHSmart is under legal duty to supply goods that conform to the contract. However, we have the right to cancel the contract we have with you if:
You return your goods damaged or used more than reasonably expected. We are entitled to deduct an amount from the refund to reflect any loss in value of the goods supplied. If we need to do this, we will contact you and provide a reason for this.
We are unable to process your payment, or a bank or merchant service provider later cancels payment.
If payment has been made fraudulently or by illegal means.
If we have made an error in pricing or product descriptions.
ii. Where you have ordered goods online you may cancel your order at any time before the goods have been despatched to you. You must do this before receiving a despatch email confirming the delivery of your goods. Any cancellation must be done by the person and cardholder who has placed the order. If you cancel by telephone, we will need to be satisfied that you are the person who placed the order. We have the right to ask for proof of identity in this case.
iii. If you are cancelling an order due to a mistake on our part, if an item is not as described, or due to goods being defective you will need to return the goods to us. We will then refund the cost of delivery and offer a product refund. We will only do this after we have done an initial inspection (applies to product defects). For more information read section 4 Product replacements and defective goods.
iv. Any changes made to your order will result in a new approximate time frame for delivery. If we can change your order, we will give you an indication of the new approximate time frame once we have confirmed your cancellation.
v. Sometimes the goods you have ordered may no longer be available from the manufacturer. In this case, we can cancel your order or offer other replacements. If your payment has been received in part or full for an order, which is subsequently cancelled by us, you will be reimbursed in full by the same method (and where applicable to the same debit/credit card used).
vi. To cancel an order email customer service at email@example.com.
vii. JHSmart reserves the right cancel orders at our discretion. If we cancel an order, it will be without charge to you.
4.Product replacements and defective goods
i. If you would like a replacement due to a product defect, then you agree to the examination and inspection of goods you have returned. We have the right to reject certain claims and have the right to get the manufacturers advice before offering any refund.
ii. Before arranging a replacement, we require photographic evidence. Please email this along with your order number to firstname.lastname@example.org for our Customer Care team to review.
iii. If we are satisfied that the goods are faulty due to manufacturing or delivery you will be offered a replacement product or a full refund of the original purchase price. We will also cover your return costs and include this with your refund.
iv. If you have ordered a product that has become out of stock, we may substitute said item to an equivalent offered from a different manufacturer. If we choose to do this, we will always make sure that we contact you in the first instance before processing the order. We can also back order the goods for you. You will always be emailed with the option to cancel your order if you would rather not wait.
5.Delivery and extra charges
i. All deliveries are subject to a delivery charge. Once you place your order, you agree to pay the delivery charge. Most deliveries are made Monday to Friday between 8am − 5pm. Delivery at this rate is only available to mainland UK. Delivery outside of the mainland UK is subject to the availability of our courier’s service in the area and cannot be guaranteed. ii. JHSmart deliveries will be fulfilled by our delivery partners Royal Mail, DPD and DHL at a flat rate of £4.99 and will be made to the address specified when you placed your order. Please make sure that there is someone aged 18 or over to sign for the goods at the time arranged for delivery.
iii. The Delivery Partner will deliver your order to the main entrance of the delivery address. If you are not available Royal Mail will leave a red delivery card for you to follow up the delivery. DHL will also leave you a card in your mailbox. DHL will automatically return the next working day. If you also missed their second delivery attempt, you could collect your parcel at a DHL location. Follow the instructions on your DHL card and on their Track & Trace page. DPD can leave your parcel somewhere safe at the delivery address, deliver it to your neighbour, drop it off at your local shop or change the delivery date provided we have not instructed to get a signature. You can find your options on their website once you have your attempted delivery card. If your order is left in a safe location and subsequently lost or damaged, we will be unable to provide a replacement item(s) or refund.
iv. Delivery times are dependent on goods being in stock. You will not receive a despatch email until your payment is approved and the billing/shipping address is verified. On the despatch email we will provide you with your tracking ID provided by Royal Mail.
v. Due to high levels of orders, it may take slightly longer to despatch your order. Additionally, adverse weather conditions and COVID restrictions could also affect delivery timeframes.
vi. If you have missed your parcel three times, the delivery partner will redeliver the package back to us. There will be an additional charge to you if you choose to have your goods redelivered to you.
vii. Orders containing pre-order items will be shipped once all items are in stock. Additional shipping costs may apply if you ask us to split the order.
viii.We will always let you know if any extra delivery charges are payable. You must pay these charges before delivery or re- delivery or, if charged after delivery, within 7 days of receiving notice of such extra delivery charges.
6.Arrival of goods
i. Please check your goods carefully before signing for them. Once you sign for the goods, you are in contract with us and have accepted it in the condition it has arrived in. If you have realised the goods are damaged after you have signed for it then Customer Care will assess your complaint, you have up to 5 working days to do so. Please provide photographic evidence and contact us immediately
ii. If you have received an item(s) in error, we will organise a collection from your address provided in your delivery instruction.
iii. If your order arrives incomplete, you must report it to us within 48 hours. Please have your order number to hand.
iv. If you have more than one item in your order this may arrive to you in separate instances.
7.Delay in delivery
i. Whilst we deliver to most areas in the UK and Ireland, we are unable to guarantee delivery within our usual lead-times, to certain areas. These include Highlands & Islands, Channel Islands, and the Isle of Man. We aim to deliver within 7-10days of you placing your order and certain goods may take longer.
ii. If we are unable to deliver your goods due to circumstances out of our control, and within the timeframe we have supplied to you, then we will notify you as soon as possible. If you cannot wait for the goods, you must let us have a notice of cancellation in writing to Customer Care at email@example.com.
iii. We cannot accept any liability for any losses you incur (including loss of earnings) or for compensation for perceived inconvenience that may be suffered due to any delay occurred on your behalf. As mentioned in section 5 Delivery and extra charges.
iv. If you believe your parcel is missing and have followed the tracking provided by Royal Mail, then we will help raise the delivery inquiry with Royal Mail and get back to you.
8.Refunds and returns
i. For our standard delivery items purchased through our website, you may wish to follow the returns procedure outlined in the delivery note. Our Returns Policy is effective for up to 14 days from receipt of delivery (signed acceptance of your item). After this period, we will not be able to offer you a refund or exchange, unless in exceptional circumstances agreed by management.
ii. All returns must be accompanied with a valid JHSmart Ltd proof of purchase receipt or dispatch confirmation email or invoice including your order reference number. We do require all the original packaging and accessories to be included in the return, we don’t accept any returns from goods that have been damaged, or with tags removed.
iii. Your refund will be processed within 7-10 days of receipt of the returned goods, or, if the goods have not yet been delivered, within 7 days of the day you gave us notice of cancellation. Until the goods are returned to us, you are responsible if the goods are lost, damaged, or destroyed. Please use a reputable courier in this case.
iv. We will provide you with a refund using the same method of payment originally used by you to pay for your purchase.
v. Please note that when you agree to these website terms, you shall be deemed to have understood and agreed to our Returns and Refunds policy in its entirety.

i. All our goods are subject to availability and if for any reason we are unable to supply any goods then you will be offered a full refund or, if available and acceptable to you, substitute goods of equivalent quality and price as outlined in section 4 Product replacements and defective goods.
ii. If you purchase the same goods under two or more orders, we cannot guarantee that the goods supplied will be from the same batch and be an exact colour match. If you are not happy with your order you can return it to us by reading our Returns and Exchanges.
iii. The images and packaging of the Products on the Site are for illustrative purposes only. Your products may vary slightly from those images. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflects the colour of the Products.
iv. To make the most out of any goods, you should follow the appropriate care instructions. The goods we sell are for general domestic use only and must be used for this intended purpose.
v. The weights and product dimensions given are approximate only
vi. The key features and product attributes are based on information provided to us by the manufacturer and these may vary.
i. We have fully trained and equipped staff who will provide you with the best customer service possible and are trained to help give you advice regarding the care of your products. Our staff are not authorised to advise on whether goods are suitable for unusual purposes. If you intend to use your products in this way, then you are held fully accountable and responsible for the outcome of the products, and we will not offer a refund or exchange under these circumstances.
i. We take your privacy very seriously and we are open and transparent about how we handle your personal information in relation to the General Data Protection Regulation.
i. You must not misuse this Website. You will not: commit or encourage a criminal offence; transmit or distribute a virus, trojan, worm or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the service; corrupt data; infringe upon the rights of any other person's proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as "spam"; or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website. Breaching this provision would constitute a criminal offence and JHSmart will report any such breach to the relevant law enforcement authorities and disclose your identity to them.
i. When we refer to "you" and "your" we mean the user of the Website and purchaser of Goods
ii. You may not transfer your rights under the contract between us to any third party without JHSmart prior written consent.
iii. If any term of these conditions of sale is determined by any competent authority to be invalid, unlawful, or unenforceable to any extent, then such term will be severed from the remaining terms which will continue to be valid to the fullest extent permitted by law.
iv. These Conditions of Sale and any contract formed with us are governed by and construed in accordance with English Law and will be subject to the exclusive jurisdiction of the courts of England and Wales.
v. Any other websites which are linked to from this site are governed by their own terms and conditions. We accept no responsibility or liability for the content or operation of websites, which are not under our control.
vi. Although we aim to offer you the best service possible, JHSmart makes no promise that the services at the site will meet your requirements. JHSmart cannot guarantee that the service will be fault free. If a fault occurs in the service, you should report it to Customer Services by email or by phone. We will attempt to correct the fault as soon as possible. Your access to the site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services.
vii. JHSmart makes no promise that materials on the Site are appropriate or available for use in locations outside the United Kingdom.
